Fair Processing Notice (Privacy Notice)

Mother Teresa Catholic Academy Trust is committed to protecting the privacy and security of personal information. This notice explains how we collect, use, store and share personal data about pupils, parents/guardians, staff, trustees, volunteers, and others in accordance with data protection law.

We are a Data Controller for the purposes of data protection legislation.


The Personal Data We Collect

We may collect, use, store and share the following categories of information:

  • Personal identifiers (name, address, contact details, date of birth, unique pupil number, national insurance number).
  • Characteristics (such as ethnicity, language, nationality, country of birth, religion).
  • Safeguarding information (court orders, professional involvement).
  • Special educational needs and disabilities (SEND) information.
  • Medical and dietary information.
  • Attendance records, assessment and attainment data.
  • Behavioural, exclusion and achievement records.
  • Images, audio or video recordings (including CCTV).
  • Employment information for staff and prospective staff (qualifications, contracts, payroll, performance, DBS checks).

Why We Use Personal Data

We process personal data in order to:

  • Support pupil learning and progress.
  • Monitor and report on pupil attainment and outcomes.
  • Provide appropriate pastoral care and safeguard pupils.
  • Meet statutory duties placed on us by law.
  • Manage admissions, attendance, and exclusions.
  • Enable staff recruitment, development, payroll, and performance management.
  • Comply with health and safety obligations.
  • Communicate effectively with parents, carers, and staff.
  • Develop the Trust’s strategy and improve the quality of education.

Legal Basis for Processing

We only process personal data where the law allows us to. The legal bases include:

  • Public task (processing necessary to perform a task in the public interest or for official functions).
  • Legal obligation (compliance with legislation, such as education or safeguarding laws).
  • Contract (where processing is necessary for the performance of a contract, e.g. staff contracts).
  • Consent (where freely given, such as for certain uses of images).
  • Vital interests (to protect someone’s life).

How We Share Personal Data

We may share personal information with:

  • Local authorities, Department for Education (DfE), and Ofsted.
  • Other schools or academies (when pupils move).
  • Exam boards and assessment organisations.
  • NHS, school nurses, health and social care services.
  • Police and other law enforcement agencies where required.
  • Suppliers and service providers (such as IT services, catering, transport, payment systems).
  • Trustees, governors, and regulators.

We do not share personal data with third parties for marketing purposes without consent.


How Long We Keep Personal Data

We keep personal information only for as long as necessary, in line with statutory requirements and the Trust’s Data Retention Policy.


Your Rights

Under data protection law, individuals have rights including:

  • Right of access to the data we hold about them.
  • Right to rectification of inaccurate data.
  • Right to erasure of data in certain circumstances.
  • Right to restrict or object to processing.
  • Right to data portability.
  • Right to withdraw consent (where this was the legal basis for processing).

Requests should be made to our Data Protection Officer (DPO).
